NRI Property Sale POA Just Got
10x Harder — 2025 Amendment

The 2025 amendment added a mandatory step that previous guides never mentioned. If you're selling property via POA and haven't re-reviewed your process, your POA may already be invalid.

The game changer: Before 2025, adjudication at the District Registrar was enough. Now, registration at the Sub-Registrar is MANDATORY for property transfer POAs. Miss this step and your POA is void for property transactions — meaning your buyer's deal falls through.

What Changed in 2025 — Old vs New

✗OLD RULE: Adjudication Only

POA for property sale needed stamp duty payment at the District Registrar (adjudication). Registration at the Sub-Registrar was optional in most states. Many NRIs completed just this one step and assumed their POA was valid for property transactions.

✦NEW RULE (2025): Adjudication + Registration Mandatory

POAs authorising sale, gift, or transfer of immovable property (Category A) MUST now be BOTH adjudicated AND registered at the Sub-Registrar's Office. This is mandatory across all states. Unregistered Category A POAs cannot be used to execute sale deeds.

⏱New Deadlines: 3 Months (Stamp) + 4 Months (Registration)

Adjudication must be done within 3 months of the POA arriving in India. Registration must be completed within 4 months of execution abroad. Missing either deadline attracts penalty stamp duty or invalidates the POA entirely.

Two Execution Routes — Which Should You Choose?

AIndian Embassy/Consulate Route (Recommended)

Sign the POA in the presence of a Consular Officer. The consulate's seal is recognised across ALL Indian states without question. No apostille needed. Cleaner, simpler, zero friction at the Sub-Registrar. Downside: requires booking an appointment at the Indian mission.

BNotary + Apostille Route

Sign before a local Notary Public in your country, then get an Apostille from the designated authority (Secretary of State in US, FCDO in UK, etc.). Faster in some countries. But some Sub-Registrar offices are less familiar with this route and may raise queries, causing delays. Choose only if the Embassy route is impractical.

Frequently Asked Questions

What changed in the 2025 POA amendment for NRI property sales?

The 2025 amendment introduced two critical changes: (1) POAs authorising transfer of immovable property (Category A) now require BOTH adjudication AND registration at the Sub-Registrar's Office — previously only adjudication was needed in most states. (2) The registration must be completed within 4 months of the POA's execution abroad. This doubles the compliance burden for NRIs and adds significant cost and timeline.

Can I use a General POA instead of a Special POA for property sale?

No. A General POA gives broad powers and is NOT accepted for property sale transactions. You must execute a Special Power of Attorney (SPA) that specifically identifies the property (by survey number, address, and title details), lists the exact powers granted, and includes an end date. Sub-Registrar offices reject General POAs for property registration.

Which is better — Embassy attestation or Notary + Apostille route?

The Indian Embassy/Consulate route is the cleanest and most universally accepted. The consulate's seal is recognised across all Indian states without question. The Notary + Apostille route is faster in Hague Convention countries but some Sub-Registrar offices are less familiar with it and may raise queries. If your timeline is tight and you want zero friction, choose the Embassy route.

What happens if I miss the 3-month stamp duty window?

If the POA arrives in India and is not presented for stamp duty adjudication within 3 months, penal stamp duty applies — typically double the normal rate. If you miss the 4-month registration deadline, the POA may be deemed invalid for property transaction purposes, and you may need to execute a fresh POA. Act immediately if you've missed either deadline.

Do I need to be physically present in India to execute a POA for property sale?

No. As an NRI, you can execute the POA entirely from abroad. Sign before the Indian Consulate/Embassy in your country of residence (preferred) or before a local Notary Public followed by Apostille. The original must then be couriered to India for adjudication and registration. You do NOT need to visit India for this process.

What documents does my attorney need to register the POA in India?

Your attorney will need: (1) The original adjudicated POA, (2) Your passport copy + OCI card (if applicable), (3) Agent's Aadhaar and PAN card, (4) Proof of relationship between you and the agent (if blood relative — birth/marriage certificate), (5) Property details (address, survey number, SRO jurisdiction), (6) Two witnesses with valid ID proof. Requirements vary slightly by state.

How much does it cost to register a POA for NRI property sale in 2026?

Costs vary by state: Maharashtra — ₹500 stamp duty + ₹500 registration; Karnataka — ₹100–500 stamp duty + registration fee; Delhi — ₹1,000–3,000 stamp duty + registration fee. Additional costs: Embassy attestation (~₹2,000–5,000) or Notary+Apostille (~₹3,000–8,000), courier (~₹3,000–6,000), lawyer drafting fees (~₹5,000–15,000). Total estimated cost: ₹15,000–40,000 depending on state and route.

Can the POA be revoked after registration?

Yes. A POA can be revoked at any time by the principal (you) while you are competent. Revocation must be documented in writing, registered at the same Sub-Registrar's Office where the POA was registered, and notice must be given to the agent. However, any property transaction completed by the agent BEFORE revocation remains valid. Consult a lawyer before revoking.
